You represent and warrant that you are at least 18 years of age or the age of majority in your jurisdiction, whichever is greater. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Services

The Dresser Inc operates as a fashion boutique and personal styling company, providing a range of services designed to enhance your wardrobe and personal style. Our Services include, but are not limited to, the following:

2.1 Fashion Boutique

We offer a curated selection of clothing, accessories, and fashion items through our physical retail location(s) and online store. Our boutique features carefully selected products from various designers and brands, as well as our own proprietary collections. Product availability, pricing, and selection may vary between our in-store and online offerings and are subject to change without prior notice.

2.2 Personal Styling Services

Our professional stylists provide personalized fashion consultation and styling services. These services may include one-on-one consultations, wardrobe assessments, personal shopping assistance, outfit curation, seasonal wardrobe planning, and special event styling. Personal styling services may be offered in-person at our retail locations, remotely via video consultation, or through our mobile application. Availability and pricing for styling services are determined at our sole discretion and may vary based on the type and scope of the service requested.

2.3 Online Presence

Our website serves as a digital platform where users can browse our product catalog, learn about our services, book styling appointments, create and manage accounts, make purchases, read editorial content and style guides, and contact our team. The website may also include user-generated content areas, social features, and integrated third-party services. We strive to ensure our website is accessible and functional, but we do not guarantee uninterrupted or error-free availability.

2.4 Mobile Application

The Dresser Inc mobile application ("App") extends our Services to your mobile device. Through the App, you may access features including but not limited to product browsing and purchasing, virtual styling consultations, appointment scheduling, push notifications about new arrivals, promotions, and order updates, personal style profiles and preferences, digital wardrobe management tools, and loyalty program tracking. The App is available for download on supported mobile platforms and devices. We reserve the right to modify, suspend, or discontinue any features of the App at any time. Use of the App is subject to these Terms as well as any additional terms and conditions presented within the App itself and the applicable app store terms of service.

3. User Accounts

To access certain features of our Services, you may be required to create a user account. When creating an account, you agree to the following:

• Accurate Information: You agree to provide truthful, accurate, current, and complete information during the registration process and to update such information as necessary to keep it accurate and current.
• Account Security: You are solely responsible for maintaining the confidentiality of your account credentials, including your password. You agree to notify us immediately of any unauthorized access to or use of your account at support@thedresserinc.org.

When using our Services, you agree to act responsibly and in compliance with all applicable laws and regulations. You agree that you will not:

• Use any automated means, including bots, scrapers, spiders, crawlers, or similar technologies, to access, collect data from, or interact with the Services without our express written permission.
• Introduce any viruses, trojans, worms, logic bombs, or other malicious or technologically harmful material to the Services.
• Resell, redistribute, or commercially exploit any aspect of the Services without our prior written consent.
• Engage in any conduct that restricts or inhibits any other user from using or enjoying the Services.
• Use the Services to solicit, advertise, or promote products or services unrelated to The Dresser Inc without our prior written consent.

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates these provisions, including removing offending content, suspending or terminating the violator's account, and reporting the violator to law enforcement authorities.

5. Intellectual Property

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and the overall design and arrangement thereof (collectively, "Content"), are the exclusive property of The Dresser Inc, its licensors, or its content suppliers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The trademarks, service marks, trade names, and logos of The Dresser Inc, including "The Dresser" and "The Dresser Inc," are the exclusive property of the Company. You may not use any of these marks without our prior written permission.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services and the Content solely for your personal, non-commercial use, subject to these Terms. This license does not include the right to:

• Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any Content, information, software, products, or services obtained from or through the Services.
• Use any data mining, robots, or similar data gathering and extraction methods on the Services.
• Download (other than page caching) any portion of the Services or Content, except as expressly permitted by us.

5.1 User-Generated Content

If the Services allow you to submit, post, or display content such as reviews, comments, photos, or other materials ("User Content"), you retain ownership of your User Content. However, by submitting User Content, you grant The Dresser Inc a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with the operation and promotion of the Services. You represent and warrant that you own or have the necessary rights and permissions to submit User Content and to grant the foregoing license.

6. Purchases and Payments

When you make a purchase through our Services, you agree to the following terms:

6.1 Pricing

All prices displayed on our Services are in United States Dollars (USD) unless otherwise noted. Prices are subject to change without notice. We make every effort to ensure pricing accuracy; however, errors may occur. In the event of a pricing error, we reserve the right to cancel any orders placed at the incorrect price and will notify you promptly of such cancellation.

6.2 Payment Methods

We accept various payment methods as indicated at checkout. By providing payment information, you represent and warrant that you are authorized to use the designated payment method and that the information you provide is true, correct, and complete. You authorize us to charge the applicable fees to your selected payment method.

6.3 Order Acceptance

Your receipt of an order confirmation does not constitute our acceptance of your order. We reserve the right to accept or decline your order for any reason, including but not limited to product availability, errors in product or pricing information, or identification of potential fraud. If we cancel an order after payment has been processed, we will issue a full refund to the original payment method.

6.4 Taxes and Shipping

You are responsible for all applicable taxes, shipping fees, and handling charges associated with your purchase. These charges will be calculated and displayed at checkout before you finalize your order. Shipping times are estimates and are not guaranteed. The Dresser Inc is not responsible for delays caused by shipping carriers, customs, or other factors beyond our control.

From time to time, we may offer promotional discounts, coupon codes, or special offers. These promotions are subject to specific terms and conditions, may not be combined with other offers unless expressly stated, and may be modified or discontinued at any time without prior notice.

7. Return and Exchange Policy

We want you to be satisfied with your purchase from The Dresser Inc. Our return and exchange policy is as follows:

• Eligibility: Items must be returned within thirty (30) days of the original purchase date. Items must be in their original, unworn, unwashed, and undamaged condition with all original tags and packaging attached.
• Non-Returnable Items: Certain items are final sale and cannot be returned or exchanged, including items marked as "Final Sale," intimate apparel, swimwear, personalized or custom-made items, gift cards, and items that have been altered or damaged after purchase.
• Return Process: To initiate a return or exchange, please contact our customer support team at support@thedresserinc.org or call us at +1(575) 312-3117. You will receive instructions for returning your item(s).
• Refunds: Once your return is received and inspected, we will notify you of the approval or rejection of your refund. Approved refunds will be processed to the original payment method within ten (10) business days. Shipping costs are non-refundable unless the return is due to our error.
• Exchanges: Exchanges are subject to product availability. If the desired item is not available, we will process a refund instead.

We reserve the right to refuse returns or exchanges that do not meet our policy requirements or that we suspect are fraudulent.

8. Disclaimer of Warranties

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• WARRANTIES THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT OR INFORMATION PROVIDED THROUGH THE SERVICES.
• WARRANTIES THAT THE RESULTS OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE.
• WARRANTIES REGARDING THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICES.

ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICES IS DONE AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR MOBILE DEVICE OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM THE DRESSER INC OR THROUGH THE SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DRESSER INC, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND EVEN IF THE DRESSER INC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL LIABILITY OF THE DRESSER INC FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO THE DRESSER INC IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, THE LIMITATIONS AND EXCLUSIONS SET FORTH IN THIS SECTION SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

10. Indemnification

You agree to defend, indemnify, and hold harmless The Dresser Inc, its directors, officers, employees, agents, partners, suppliers, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to reasonable attorney's fees) arising from or related to:

• Your access to or use of the Services.
• Your violation of these Terms.
• Your violation of any applicable law, regulation, or third-party rights, including intellectual property rights, privacy rights, or publicity rights.
• Any User Content you submit, post, or otherwise make available through the Services.
• Any dispute between you and any third party arising from or related to the Services.
• Any negligent, fraudulent, or willfully wrongful act or omission by you.

The Dresser Inc reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you agree to cooperate with The Dresser Inc in asserting any available defenses. This indemnification obligation shall survive the termination of these Terms and your use of the Services.

11. Governing Law

These Terms and any dispute or claim arising out of or in connection with them, their subject matter, or their formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of New York, United States of America, without regard to its conflict of law principles.

You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Services shall be brought exclusively in the state or federal courts located in Nassau County, New York, and you hereby consent to the personal jurisdiction and venue of such courts. You waive any objection to the exercise of jurisdiction over you by such courts and to venue in such courts.

12. Dispute Resolution

We encourage you to contact us first if you have a concern or dispute. Most disputes can be resolved informally by reaching out to our customer support team at support@thedresserinc.org.

12.1 Informal Resolution

Before initiating any formal dispute resolution proceeding, you agree to first contact The Dresser Inc and attempt to resolve the dispute informally by sending a written notice describing the nature of the dispute and the relief sought to our email address. The parties agree to negotiate in good faith to resolve the dispute for a period of at least thirty (30) days from the date the notice is received.

12.2 Binding Arbitration

If the dispute cannot be resolved through informal negotiation within thirty (30) days, either party may elect to resolve the dispute through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in Nassau County, New York, by a single arbitrator selected in accordance with AAA rules. The arbitrator's decision shall be final and binding on the parties and may be entered as a judgment in any court of competent jurisdiction.

12.3 Class Action Waiver

YOU AND THE DRESSER INC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Unless both parties agree otherwise, the arbitrator may not consolidate or join more than one person's claims, and may not preside over any form of a consolidated, representative, or class proceeding.

12.4 Exceptions

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights. Additionally, disputes involving amounts less than $10,000 may be brought in small claims court in Nassau County, New York.

13. Termination

We may terminate or suspend your access to the Services, in whole or in part, at any time, with or without cause, and with or without notice, effective immediately. Reasons for termination may include, but are not limited to:

• Violation of these Terms or any other policies or guidelines referenced herein.
• A request by you to delete your account or cancel your subscription.
• A request or order by law enforcement, a judicial body, or other government authority.
• Discontinuation or material modification of the Services or any part thereof.
• Unexpected technical or security issues or problems.
• Extended periods of inactivity.
• Engagement in fraudulent or illegal activities.

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, limitations of liability, and dispute resolution provisions.

If you wish to terminate your account, you may do so by contacting us at support@thedresserinc.org. Please note that termination of your account does not relieve you of any obligations incurred prior to termination, including any outstanding payment obligations.

14. Changes to Terms

The Dresser Inc reserves the right, at its sole discretion, to modify, amend, or replace these Terms at any time. When we make changes, we will update the "Effective Date" at the top of these Terms and, for material changes, we may provide additional notice through one or more of the following methods:

• Posting a prominent notice on our website.
• Sending a notification through our mobile application.
• Sending an email to the address associated with your account.

It is your responsibility to review these Terms periodically for any changes. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes. If you do not agree to the new Terms, you must stop using the Services and, if applicable, delete your account.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms. The remaining provisions shall continue in full force and effect, and the invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving the intent of the original provision.

If such modification is not possible, the offending provision shall be severed from these Terms, and the remaining provisions shall be interpreted as if the severed provision had never been included. The failure of The Dresser Inc to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by The Dresser Inc in writing.
